Indianapolis FMLA Lawyer

Indiana Family and Medical Leave Act Attorney

If you or a family member has been demoted or terminated while on approved leave or denied leave under qualifying conditions, you should contact a lawyer immediately.

The Family and Medical Leave Act (FMLA) was created to give employees time away from work to handle stressful situations at home. Taking time off to deal with situations such as pregnancy, adoption, terminally ill parents, or an injured child or spouse can be protected. An Indianapolis FMLA attorney at the office of Stephanie Jane Hahn, Attorney at Law can examine your dilemma and explain your options and protections.

The FMLA allows qualified workers to take up to 12 weeks of unpaid time off to handle family or medical issues. It is important to note that the 12 weeks do not have to be taken consecutively. The time off can be taken in smaller stretches of days or weeks.

FMLA Requirements

There are three main requirements that an employer and employee must meet to qualify for FMLA protection:

  • Employer must have at least 50 employees
  • Employee must have been employed by employer for at least one year
  • Employee must have worked at least 1,250 hours in the last 12 months of employment

If you and your employer meet the necessary requirements and your employer does not offer FMLA as an option or denies approving your leave after you've filled out the proper paperwork, it is time to contact a lawyer. We can examine your specific situation, and we can advise and represent you through your best course of action.
