Pregnancy Discrimination

When you’re expecting, you have enough on your plate to prepare for the birth of your child. You shouldn’t have to worry about losing your job or getting demoted due to pregnancy.

Fortunately, the Pregnancy Discrimination Act makes it illegal for employers to discriminate against you on the basis of pregnancy, childbirth, breastfeeding or related medical conditions. This means your employer (or prospective employer) cannot:

  • Refuse to hire you because you’re pregnant
  • Fire or demote you because you’re pregnant
  • Rescind your health care benefits
  • Change your job descriptions or duties
  • Withhold promotional opportunities
  • Impose less favorable terms and conditions of employment on you
  • Refuse to grant you leave under the Family and Medical Leave Act

Additionally, your employer has a duty to make reasonable accommodations for your pregnancy. Depending on your situation, you may be entitled to less physically rigorous job duties, a more flexible work schedule or breastfeeding breaks, for example.
